This Privacy Policy is meant to help you understand how Fueled collects, uses, and shares Customer Data to operate, improve, develop, and protect Fueled’s Services. This Privacy Policy applies to Customer Data processed as a result of access to or use by our developer customers, (“Developers”, “you”, or “your”) of the Fueled websites (“Website”), dashboard (“Dashboard”), our Platform ( “Platform”), related tools, and other products or services (collectively, the “Services”) provided by Fueled, Inc. (“Fueled”, “we”, “us”, or “our”).
Introduction
At Fueled, we value customer trust above all else. As such, we strive to help our customers, our customers’ end-users, and our Website visitors maintain control of their information. This Privacy Policy explains our information practices, the kinds of information we may collect, how we intend to use and share that information, and how you can exercise choices you may have in Customer Data.Fueled processes three broad categories of personal information (known collectively as “Customer Data”):
- As a developer customer (or potential developer customer) of Fueled, you will need to provide us information to create an account and use the Services – we refer to this as “Customer Account Data.”
- As a developer customer, you may provide us with personal information of your end-users who use or interact with Your application that you’ve built on Fueled’s Platform or integrated with Fueled’s Services – we refer to this information as “Customer End-User Data.”
How Fueled Processes Customer Account Data
We, Fueled, collect and process your Customer Account Data:- When you visit a Fueled public-facing Website like Fueled.io, sign up for a Fueled event, or make a request to receive information about Fueled or our products, like a Fueled’s white paper or a newsletter;
- When you contact Fueled’s Sales Team or Customer Support Team;
- When you sign up for a Fueled’s account and use our products and Services.
Broadly speaking, we use Customer Account Data to:
- Perform our contract with you;
- Pursue our legitimate interests to:
- understand who our customers and potential customers are and their interests in Fueled’s products and Services
- manage our relationship with you and other customers,
- provide you with marketing materials,
- perform research (including marketing research),
- carry out core business operations such as accounting and filing taxes,
- help detect, prevent, or investigate security incidents, fraud and other abuse and/or misuse of our products and services;
- Comply with any legal obligations we may have;
- Carry out other uses which you have consented to.
What Customer Account Data Fueled Processes When You Visit Our Website, Sign Up for a Fueled Event, or Make a Request for Information About Fueled and Why
When you visit our Website, sign up for a Fueled’s event or request more information about Fueled, we will collect information that you submit to us (e.g., through a web form) and we will also collect information automatically using tracking technologies like cookies. We collect this information to fulfill your request, to learn more about who is interested in our products and services, to advertise to you, and to improve our Services.
Information You Share Directly:
In some places on Fueled’s Websites, you can fill out web forms to ask to be contacted by our Sales Team, sign up for a marketing or a newsletter, register for a Fueled event, or take a survey. The specific personal information requested on these forms will vary based on the purpose of the form. We will ask you for information necessary for us to provide you with what you request through the form (for example, we will ask you for your email address if you want to sign up for an email newsletter and for your phone number if you want a member of our Sales Team to call you). We may also ask you for additional information to help us understand you better as a customer like your Fueled use case, your company name, or your role at your company. If you sign up to receive marketing communications from Fueled, like a newsletter, you can always choose to opt-out of further communications through a preferences page which will be linked from any marketing email you receive from Fueled. You may also contact our Customer Support Team to communicate your choice to opt-out.
Information We Collect Automatically:
When you visit Fueled’s Websites, including our web forms, we and service providers acting on our behalf automatically collect certain information using tracking technologies like cookies, web beacons, and similar technologies. We use this information to understand how visitors to our Websites are using them, which pages and features of the Websites are most popular, and to tailor and deliver advertisements. This helps us understand how we can improve our Websites and track performance of our advertisements.We may use Google Analytics to collect information regarding visitor behavior and visitor demographics on our Website and Services. How Long We Retain Customer Data
We retain personal information for as long as it is needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods and criteria vary by the category of Customer Data:- Customer Account Data (name, email address, company details, account credentials): Retained for the duration of your account with Fueled, plus up to ninety (90) days following account closure to allow for account reactivation and orderly removal from our active systems, unless a longer period is required to comply with our legal obligations, resolve disputes, or enforce our agreements.
- Billing and payment records: Retained for seven (7) years following the relevant transaction, as required by applicable tax, accounting, and financial reporting obligations.
- Support communications: Retained for twenty-four (24) months after the resolution of your support request, so that we can reference prior issues if you contact us again and improve our support operations.
- Marketing data (newsletter sign-ups, event registrations, marketing preferences): Retained until you opt out of marketing communications or after twenty-four (24) months of inactivity, whichever occurs first. If you opt out, we retain a minimal suppression record (such as your email address) for as long as necessary to honor your opt-out preference.
- Website analytics and cookie data: Retained in accordance with the durations of the cookies and similar technologies described in this Privacy Policy, generally not exceeding twenty-six (26) months.
- Customer End-User Data (including identity graph identifiers and associated event data): We process Customer End-User Data on behalf of, and at the direction of, our developer customers. Because the accuracy of identity resolution depends on longitudinal history, identifiers and associated events in our identity graph are retained for as long as they remain necessary to provide the Services to the relevant customer, rather than for a fixed period. We delete or de-identify Customer End-User Data upon a verified deletion request from the relevant customer or end-user, upon termination of the relevant customer's use of the Services (subject to any legal retention obligations), or when the data no longer serves the purposes described in this Privacy Policy.
Where We Store and Process Customer Data
Fueled stores and processes Customer Data on infrastructure provided by Amazon Web Services (AWS) located in the United States (US East region). This includes personal data relating to individuals located in the European Economic Area (EEA), the United Kingdom, and Switzerland, which is transferred to and processed in the United States. Where we transfer personal data out of the EEA, the United Kingdom, or Switzerland, we do so subject to appropriate safeguards recognized under applicable data protection law, such as the European Commission's Standard Contractual Clauses (and their UK equivalent), which we incorporate into our data processing agreements with customers and service providers.
Your Rights if You Are Located in the EU/EEA
If you are located in the EU/EEA, you have the following rights under the General Data Protection Regulation (GDPR) with respect to personal data for which Fueled is the controller:- The right to access the personal data we hold about you;
- The right to request that we rectify inaccurate or incomplete personal data;
- The right to request that we erase your personal data;
- The right to request that we restrict the processing of your personal data;
- The right to data portability;
- The right to object to our processing of your personal data, including processing based on our legitimate interests and processing for direct marketing purposes;
- The right to withdraw your consent at any time, where our processing is based on your consent.
Right to lodge a complaint with a supervisory authority. If you believe that our processing of your personal data infringes the GDPR, you have the right to lodge a complaint with a data protection supervisory authority — in particular, in the EU/EEA member state of your habitual residence, your place of work, or the place of the alleged infringement. A list of supervisory authorities and their contact details is available on the European Data Protection Board's website at https://www.edpb.europa.eu/about-edpb/about-edpb/members_en. We would, however, appreciate the chance to address your concerns before you approach a supervisory authority, so please consider contacting us first.
